Terms of Service
Last updated: May 2026
1. Service description
Top5 is an AI-powered CV screening platform operated by LEFTFIELD SOLUTIONS FZE, a company registered in the United Arab Emirates ("we", "us", "our"). The service allows users ("you") to upload candidate CVs, score them using AI-based Topgrading methodology, and generate shortlists for hiring decisions.
By creating an account and using Top5, you agree to these Terms of Service. If you do not agree, do not use the service.
2. Eligibility
You must be at least 18 years old and have the authority to bind yourself or your organisation to these terms. The service is intended for business use in hiring and recruitment contexts.
3. User responsibilities
You agree to:
- Provide accurate account information and keep it up to date
- Use the service only for lawful hiring and recruitment purposes
- Comply with all applicable employment, data protection, and equal opportunity laws in your jurisdiction
- Not upload content that is illegal, fraudulent, or infringes third-party rights
- Not attempt to reverse-engineer, scrape, or abuse the service
- Keep your login credentials confidential
You are responsible for all activity that occurs under your account.
Who is responsible for what
Top5 is a decision-support tool. The same split applies on every page here, in the data processing agreement and in the Customer AI Use Guide.
- You, the customer, own:
- lawful hiring use · candidate notices · human review before any decision that affects a candidate, including rejecting or setting one aside · EU AI Act deployer duties · NYC Local Law 144 duties, including the bias audit, the candidate notice and the alternative process · FCRA and local employment-law duties · and every final decision.
- Top5 owns:
- the platform · the truth of what we do with your data and candidates' data · our sub-processors and where they run · AI transparency, including what the system does and where it can be wrong · logging and audit records · and the provider-side evidence a regulator may ask us for.
Top5 is not a background-check service and not a consumer-reporting agency. How Top5 uses AI
4. AI advisory notice and human-review requirement
Top5 uses artificial intelligence to analyse CVs and generate candidate scores and rankings. AI-generated scores are advisory only.
Contractual requirement (not merely advisory): you must not make any final hiring, rejection, shortlisting, or progression decision based solely on AI-generated output from Top5. Every final decision must be taken by a qualified human reviewer who has independently reviewed the candidate's CV, interview, or other evidence. Top5 is decision support, not an automated decision-maker.
AI models may produce errors, biases, or inaccurate assessments. You are responsible for independently verifying any AI output before acting on it.
We accept no liability for hiring outcomes, employment disputes, or discrimination claims arising from use of AI-generated scores.
4a. EU AI Act — deployer obligations
For EU candidates, Top5 is a high-risk AI system under Annex III of the EU AI Act (Regulation 2024/1689). In that framework, LEFTFIELD SOLUTIONS FZE is the provider and you, as the employer or recruiter using Top5, are the deployer under Article 26.
As deployer, you agree to:
- Inform candidates, in advance of CV submission, that AI is used to assist screening (Article 26(7))
- Ensure a human reviewer assesses every AI output that materially affects a candidate (Article 14)
- Carry out, where applicable, a Fundamental Rights Impact Assessment (Article 27)
- Retain Top5 system logs and your own oversight evidence for the period required by applicable law
- Not use Top5 for any purpose other than the intended purpose described in our AI Disclosure
We make our Annex IV technical documentation available to enterprise customers on request at legal@top5cv.com. See our AI Disclosure page for further detail.
4b. New York City — restricted use
Top5 does not currently permit unaudited use for hiring covered by NYC Local Law 144 (the Automated Employment Decision Tools law).
You agree not to use Top5 for any role where Local Law 144 applies, including roles based in whole or in part in New York City, fully remote roles tied to an NYC office, or roles offered by an employment agency located in NYC — unless you (the customer) have independently:
- Commissioned a bias audit of Top5 (or your overall AEDT pipeline) within the past 12 months
- Published a summary of the bias audit results in line with §5-301 of NYC LL 144
- Given candidates the required notice at least 10 business days before AEDT use
- Disclosed the job qualifications and characteristics the tool considers
See our NYC AEDT Notice for the full position. If your role is NYC-covered and you have not satisfied the above, you must not submit candidate CVs through Top5 for that role.
5. Candidate data
When you upload CVs, you are processing personal data about third parties. You represent and warrant that:
- You have a lawful basis to process candidate personal data
- Candidates have been informed their data may be processed by AI tools (or you have a legitimate interest basis)
- You will handle candidate data in compliance with GDPR, UK GDPR, or applicable data protection law
We process candidate data on your behalf as a data processor. See our Privacy Policy for details.

7. Intellectual property
Top5, its logo, and all software are owned by LEFTFIELD SOLUTIONS FZE. You may not copy, reproduce, or distribute any part of the service without written permission.
You retain ownership of the CV files you upload and the content you create. By uploading CVs, you grant us a limited licence to process them solely to provide the service.
8. Limitation of liability
To the maximum extent permitted by law, Top5 is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free AI outputs, or fitness for any particular purpose.
Our total liability to you in any 12-month period is limited to the amount you paid us in that period. We are not liable for indirect, consequential, or incidental damages.
9. Termination
You may close your account at any time from your account settings. On closure, your data will be deleted within the timeframes described in our Privacy Policy.
We may suspend or terminate your account if you breach these terms, engage in abusive behaviour, or if required by law. We will give reasonable notice where possible.
10. Changes to these terms
We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance.
11. Governing law
These terms are governed by the laws of the United Arab Emirates. Any disputes will be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
This does not affect mandatory consumer protection rights you may have under the laws of your country of residence (e.g. UK Consumer Rights Act 2015 for UK consumers, EU consumer protection law for EU consumers).
